1. WJ Tuning – Algemene Voorwaarden (Nederlands)

   Artikel 1 – Definities

   WJ Tuning: de eenmanszaak gevestigd in Nederland en actief via www.wjtuning.nl.

   Klant: de natuurlijke persoon of rechtspersoon die een overeenkomst aangaat met WJ Tuning.

   Overeenkomst: iedere overeenkomst tussen WJ Tuning en de Klant betreffende de levering van producten en/of diensten.

   Producten: alle producten, onderdelen, accessoires, tuningonderdelen, digitale bestanden en diensten aangeboden via de webshop.

   Digitale Producten: downloadbare bestanden zoals STL-bestanden, CAD-bestanden, handleidingen en andere digitale content.

   Bedenktijd: de termijn waarbinnen de Klant gebruik kan maken van het herroepingsrecht.

   Betaalprovider: derde partijen zoals Mollie die betalingen verwerken.

   ---

   Artikel 2 – Toepasselijkheid

   Deze algemene voorwaarden zijn van toepassing op alle aanbiedingen, bestellingen, overeenkomsten en leveringen van WJ Tuning.

   Door een bestelling te plaatsen gaat de Klant akkoord met deze voorwaarden.

   Afwijkingen van deze voorwaarden zijn uitsluitend geldig indien schriftelijk overeengekomen.

   ---

   Artikel 3 – Aanbod

   Alle aanbiedingen op de webshop zijn vrijblijvend en kunnen op ieder moment worden gewijzigd.

   Kennelijke fouten, typefouten, prijsfouten of onjuiste productinformatie binden WJ Tuning niet.

   Productafbeeldingen, kleuren, specificaties en beschrijvingen zijn zo nauwkeurig mogelijk weergegeven maar kunnen afwijken van de werkelijkheid.

   Vermelde prestaties, tuningresultaten of compatibiliteit zijn indicatief en afhankelijk van configuratie, montage, afstelling en gebruik.

   ---

   Artikel 4 – Totstandkoming van de Overeenkomst

   De overeenkomst komt tot stand zodra de Klant een bestelling plaatst en WJ Tuning deze bevestigt.

   WJ Tuning behoudt zich het recht voor bestellingen zonder opgaaf van reden te weigeren of annuleren.

   Indien een product niet beschikbaar blijkt te zijn, zal de Klant zo spoedig mogelijk worden geïnformeerd en een vervanging, tegoed of terugbetaling aangeboden krijgen.

   ---

   Artikel 5 – Prijzen en Betaling

   Alle vermelde prijzen zijn inclusief btw tenzij anders aangegeven.

   Verzendkosten zijn exclusief tenzij anders vermeld.

   Betaling dient te geschieden via de aangeboden betaalmethoden.

   Bij betaling via bankoverschrijving dient het volledige bedrag binnen 7 dagen te zijn voldaan.

   WJ Tuning behoudt zich het recht voor bestellingen op te schorten of te annuleren bij vermoeden van fraude, misbruik of mislukte betalingen.

   ---

   Artikel 6 – Levering en Verzending

   WJ Tuning streeft ernaar bestellingen binnen de aangegeven levertijd te verzenden. Levertijden zijn indicatief en geen fatale termijnen.

   Vertragingen geven geen recht op schadevergoeding of ontbinding tenzij wettelijk verplicht.

   Verzendkosten worden duidelijk weergegeven tijdens het afrekenen.

   Indien een bestelling in aanmerking kwam voor gratis verzending op basis van een minimale orderwaarde en een retourzending ervoor zorgt dat de resterende orderwaarde onder deze grens komt, behoudt WJ Tuning zich het recht voor de standaard verzendkosten alsnog in rekening te brengen of te verrekenen met het terug te betalen bedrag.

   Het risico van verlies of beschadiging gaat over op de Klant vanaf het moment van levering tenzij dwingend recht anders bepaalt.

   ---

   Artikel 7 – Herroepingsrecht

   Consumenten hebben het recht de overeenkomst binnen 14 dagen na ontvangst van het product zonder opgave van reden te ontbinden.

   WJ Tuning accepteert geen retouraanvragen meer na 14 dagen na levering, tenzij wettelijk anders verplicht.

   De Klant dient de herroeping binnen de bedenktijd per e-mail aan WJ Tuning te melden en het product binnen 14 dagen na melding retour te sturen.

   Retourkosten zijn voor rekening van de Klant tenzij anders overeengekomen.

   De Klant mag het product uitsluitend beoordelen zoals redelijkerwijs mogelijk zou zijn in een fysieke winkel.

   Producten dienen compleet en indien redelijk mogelijk in originele verpakking retour gestuurd te worden.

   Indien geretourneerde producten beschadigingen, montagemarkeringen, slijtage, ontbrekende onderdelen of gebruikssporen vertonen die verder gaan dan normale beoordeling, behoudt WJ Tuning zich het recht voor een waardevermindering toe te passen.

   Producten die zijn gemonteerd, aangepast, bewerkt, gespoten of gebruikt kunnen uitgesloten worden van volledige terugbetaling.

   Indien WJ Tuning één of meerdere vervangende producten heeft geleverd als service of klachtoplossing en de Klant vervolgens alsnog afziet van de aankoop, behoudt WJ Tuning zich het recht voor redelijke kosten voor extra verzending, verpakking, verwerking en inspectie te verrekenen met het terug te betalen bedrag voor zover wettelijk toegestaan.

   Terugbetalingen worden binnen 14 dagen na ontvangst en inspectie van het geretourneerde product verwerkt via dezelfde betaalmethode als gebruikt bij aankoop.

   ---

   Artikel 8 – Uitsluiting van Herroepingsrecht

   Het herroepingsrecht geldt niet voor:

   • maatwerkproducten;

   • gepersonaliseerde producten;

   • speciaal bestelde producten;

   • verzegelde producten die om hygiënische of veiligheidsredenen niet retour kunnen na opening;

   • digitale producten zodra download of toegang is gestart.

   Digitale producten zoals STL-bestanden, CAD-bestanden en downloads zijn na levering of download niet restitueerbaar.

   ---

   Artikel 9 – Garantie en Klachten

   WJ Tuning garandeert dat geleverde producten bij levering redelijkerwijs voldoen aan de overeenkomst.

   Garantie dekt uitsluitend fabricagefouten die aanwezig waren bij levering.

   De Klant dient klachten of defecten binnen 14 dagen na ontdekking te melden en op verzoek voldoende informatie, foto’s of bewijs aan te leveren.

   Bij een gegronde klacht kan WJ Tuning naar eigen keuze:

   • het product repareren;

   • het product vervangen;

   • een gedeeltelijke terugbetaling aanbieden;

   • een volledige terugbetaling aanbieden.

   WJ Tuning behoudt zich het recht voor verdere kosteloze vervangingen te weigeren indien geen aantoonbaar fabricagefout aanwezig is.

   Normale slijtage, racegebruik, verkeerd gebruik, onjuiste montage, verkeerde afstelling, oververhitting, onvoldoende smering, detonatie, foutieve montage, verkeerde brandstofmengsels, modificaties door derden of schade door onjuist gebruik vallen niet onder garantie.

   Performance- en tuningonderdelen zijn bedoeld voor ervaren gebruikers en kunnen professionele montage, afstelling of aanvullende modificaties vereisen.

   WJ Tuning kan geen specifieke vermogenswinst, compatibiliteit, betrouwbaarheid of geschiktheid garanderen voor iedere motorconfiguratie of toepassing.

   Montage of gebruik van een product geldt als acceptatie van de staat en compatibiliteit van het product tenzij sprake is van een aantoonbare fabricagefout.

   Klachten zonder voldoende bewijs kunnen worden afgewezen.

   ---

   Artikel 10 – Aansprakelijkheid

   WJ Tuning is niet aansprakelijk voor indirecte schade waaronder gevolgschade, winstderving, bedrijfsstilstand of inkomensverlies.

   WJ Tuning is niet aansprakelijk voor persoonlijk letsel, ongevallen, lichamelijke schade, overlijden of andere schade voortvloeiend uit installatie, gebruik, misbruik, modificatie of gebruik van door WJ Tuning geleverde producten.

   Performance- en tuningproducten verhogen mechanische belasting en vereisen professionele montage en onderhoud. De Klant accepteert alle risico’s die samenhangen met het gebruik hiervan.

   WJ Tuning is niet aansprakelijk voor schade, motorfalen, verminderde levensduur of gevolgschade voortvloeiend uit aangepaste, getunede, gefreesde, gepoorte of op prestaties aangepaste producten, waaronder cilinders, carters, cilinderkoppen of andere motoronderdelen.

   De Klant erkent dat tuning en prestatieverhogende modificaties extra mechanische belasting veroorzaken en invloed kunnen hebben op betrouwbaarheid, duurzaamheid, warmteontwikkeling, toleranties en levensduur.

   WJ Tuning is niet aansprakelijk voor scheuren, vastlopers, coatingproblemen, materiaalmoeheid, detonatieschade, oververhitting of andere defecten die ontstaan tijdens of na gebruik van getunede producten.

   Dit omvat onder andere:

   • schade door verhoogde belasting of toerentallen;

   • defecten aan aangepaste motoronderdelen;

   • loslaten of afbreken van Nikasil-deeltjes of cilinderwanddelen;

   • zuiger- of krukasschade;

   • lagerschade;

   • schade door onvoldoende smering;

   • schade ontstaan door race- of circuitgebruik.

   Alle tuning- en freeswerkzaamheden worden uitgevoerd op eigen risico van de Klant.

   WJ Tuning is niet verantwoordelijk voor boetes, WOK-status, inbeslagname van voertuigen, afkeuringen, verzekeringsproblemen of andere juridische of financiële gevolgen voortvloeiend uit het gebruik van niet-EU-goedgekeurde, race-, tuning- of niet-straatlegale onderdelen op de openbare weg.

   Bepaalde producten zijn uitsluitend bedoeld voor race-, circuit- of offroadgebruik en voldoen mogelijk niet aan lokale wet- en regelgeving.

   De Klant blijft zelf verantwoordelijk voor het controleren of het gebruik van een product is toegestaan volgens de wetgeving van het betreffende land of gebied.

   WJ Tuning is niet aansprakelijk voor schade als gevolg van:

   • onjuiste montage;

   • verkeerde afstelling;

   • verkeerd gebruik;

   • racegebruik;

   • oververhitting;

   • smeerproblemen;

   • incompatibiliteit met andere onderdelen;

   • foutieve assemblage;

   • het niet opvolgen van instructies;

   • gebruik buiten de bedoelde toepassing.

   Iedere aansprakelijkheid van WJ Tuning is beperkt tot maximaal het aankoopbedrag van het betreffende product tenzij dwingend recht anders bepaalt.

   ---

   Artikel 11 – Digitale Producten en STL-bestanden

   Alle STL-bestanden, CAD-bestanden en digitale producten zijn uitsluitend bedoeld voor persoonlijk gebruik tenzij schriftelijk anders overeengekomen.

   Het is niet toegestaan digitale producten zonder schriftelijke toestemming van WJ Tuning te verspreiden, door te verkopen of commercieel te exploiteren.

   WJ Tuning is niet verantwoordelijk voor:

   • mislukte prints;

   • printerkalibratieproblemen;

   • materiaalincompatibiliteit;

   • maatverschillen;

   • printkwaliteit;

   • duurzaamheid;

   • printerinstellingen;

   • toleranties;

   • schade veroorzaakt door geprinte onderdelen.

   De Klant blijft verantwoordelijk voor het kiezen van geschikte materialen en veilig gebruik.

   ---

   Artikel 12 – Retouren en Transport

   Geretourneerde producten dienen degelijk verpakt te worden om transportschade te voorkomen.

   Schade ontstaan tijdens retourtransport door onvoldoende verpakking blijft voor rekening van de Klant.

   WJ Tuning behoudt zich het recht voor terugbetalingen uit te stellen totdat producten zijn ontvangen en gecontroleerd.

   Ongeautoriseerde retourzendingen kunnen worden geweigerd.

   ---

   Artikel 13 – Overmacht

   WJ Tuning is niet verplicht verplichtingen na te komen indien dit redelijkerwijs onmogelijk is door overmacht waaronder:

   • natuurrampen;

   • stakingen;

   • transportproblemen;

   • storingen bij leveranciers;

   • internetstoringen;

   • stroomuitval;

   • overheidsmaatregelen.

   Indien overmacht langer dan 30 dagen duurt, hebben beide partijen het recht de overeenkomst te beëindigen.

   ---

   Artikel 14 – Privacy en Gegevensbescherming

   WJ Tuning verwerkt persoonsgegevens conform de AVG/GDPR en toepasselijke privacywetgeving.

   Gegevens worden uitsluitend gebruikt voor orderverwerking, klantenservice en wettelijke verplichtingen tenzij anders overeengekomen.

   Persoonsgegevens worden niet verkocht aan derden.

   ---

   Artikel 15 – Toepasselijk Recht en Geschillen

   Op deze voorwaarden is uitsluitend Nederlands recht van toepassing.

   Geschillen worden voorgelegd aan de bevoegde rechter in Nederland tenzij dwingend consumentenrecht anders bepaalt.

   Consumenten binnen de Europese Unie kunnen tevens gebruikmaken van het Europese ODR-platform indien van toepassing.

   WJ Tuning – General Terms and Conditions (English)

   Article 1 – Definitions

   WJ Tuning: the sole proprietorship established in the Netherlands operating through www.wjtuning.nl.

   Customer: the natural or legal person entering into an agreement with WJ Tuning.

   Agreement: any agreement between WJ Tuning and the Customer relating to the sale of products and/or services.

   Products: all products, parts, accessories, tuning components, digital files, and services offered through the webshop.

   Digital Products: downloadable files including STL files, CAD files, manuals, and other digital content.

   Reflection Period: the period within which the Customer may exercise the right of withdrawal.

   Payment Provider: third parties such as Mollie that process payment transactions.

   ---

   Article 2 – Applicability

   These terms and conditions apply to all offers, orders, agreements, and deliveries of WJ Tuning.

   By placing an order, the Customer agrees to these terms and conditions.

   Deviations from these terms are only valid if agreed upon in writing.

   ---

   Article 3 – The Offer

   All offers on the webshop are non-binding and may be modified at any time.

   Obvious mistakes, typographical errors, pricing errors, or incorrect product information do not bind WJ Tuning.

   Product images, colors, specifications, and descriptions are intended to be as accurate as possible but may differ from the actual product.

   Performance figures, tuning results, or compatibility information are indicative only and may vary depending on setup, installation, tuning, and usage.

   ---

   Article 4 – The Agreement

   The agreement is concluded once the Customer places an order and WJ Tuning confirms it.

   WJ Tuning reserves the right to refuse or cancel orders without stating a reason.

   If a product becomes unavailable after ordering, the Customer will be informed and offered a replacement, store credit, or refund.

   ---

   Article 5 – Prices and Payment

   All prices displayed are inclusive of VAT unless stated otherwise.

   Shipping costs are excluded unless explicitly stated.

   Payment must be completed using one of the offered payment methods.

   Orders paid by bank transfer must be fully paid within 7 days.

   WJ Tuning reserves the right to suspend or cancel orders in cases of suspected fraud, abuse, or failed payment.

   ---

   Article 6 – Delivery and Shipping

   WJ Tuning aims to dispatch orders within the stated delivery times. Delivery times are estimates and not strict deadlines.

   Delays do not entitle the Customer to compensation or cancellation unless legally required.

   Shipping costs are clearly displayed during checkout.

   If an order qualified for free shipping based on a minimum order value and a returned item causes the remaining order value to fall below that threshold, WJ Tuning reserves the right to deduct the standard shipping costs from the refund amount.

   Risk of loss or damage transfers to the Customer upon delivery unless mandatory law states otherwise.

   ---

   Article 7 – Right of Withdrawal

   Consumers have the right to withdraw from the agreement within 14 days after receiving the product without giving a reason.

   WJ Tuning does not accept return requests submitted more than 14 days after delivery unless legally required.

   The Customer must notify WJ Tuning of the withdrawal via email within the reflection period and return the product within 14 days after notification.

   Return shipping costs are the responsibility of the Customer unless otherwise agreed.

   The Customer may inspect and assess the product only as reasonably necessary to determine its nature, characteristics, and functioning, similar to what would be allowed in a physical store.

   Products must be returned complete and, where reasonably possible, in original packaging.

   If returned products show damage, installation marks, excessive wear, missing parts, or signs of use beyond normal inspection, WJ Tuning reserves the right to apply a proportional reduction in the refund amount.

   Products that have been installed, modified, machined, painted, or used may be excluded from full refund eligibility.

   If WJ Tuning has provided one or more replacement products as a service or complaint resolution and the Customer subsequently withdraws from the purchase, WJ Tuning reserves the right to deduct reasonable costs for additional shipping, handling, packaging, inspection, and processing from the refund amount where legally permitted.

   Refunds will be processed within 14 days after receipt and inspection of the returned product using the original payment method.

   ---

   Article 8 – Exclusion of Right of Withdrawal

   The right of withdrawal does not apply to:

   • custom-made products;

   • personalized products;

   • special-order items;

   • sealed goods unsuitable for return after opening due to hygiene or safety reasons;

   • digital products once access or download has started.

   Digital products including STL files, CAD files, and downloads are non-refundable once delivered or downloaded.

   ---

   Article 9 – Warranty and Complaints

   WJ Tuning guarantees that delivered products reasonably conform to the agreement at the time of delivery.

   Warranty only covers manufacturing defects present at the time of delivery.

   The Customer must report complaints or defects within 14 days after discovery and provide sufficient evidence, photographs, or information upon request.

   In the event of a valid complaint, WJ Tuning may at its sole discretion:

   • repair the product;

   • replace the product;

   • provide a partial refund;

   • provide a full refund.

   WJ Tuning reserves the right to refuse further free replacements where no manufacturing defect can be established.

   Normal wear, racing use, misuse, incorrect installation, improper tuning, overheating, insufficient lubrication, detonation, incorrect assembly, unsuitable fuel mixtures, third-party modifications, or damage caused by improper use are excluded from warranty coverage.

   Performance and tuning parts are intended for experienced users and may require professional installation, tuning, or additional modifications.

   WJ Tuning cannot guarantee specific power gains, compatibility, reliability, or suitability for every engine configuration or application.

   Installation or use of a product constitutes acceptance of the product’s condition and compatibility unless a manufacturing defect is demonstrably present.

   Complaints without sufficient evidence may be rejected.

   ---

   Article 10 – Liability

   WJ Tuning is not liable for indirect damages including consequential damages, loss of profit, business interruption, or loss of income.

   WJ Tuning is not liable for personal injury, accidents, physical harm, death, or damage resulting from installation, use, misuse, modification, or operation of products supplied by WJ Tuning.

   Performance and tuning products increase mechanical stress and require professional installation and maintenance. The Customer accepts all risks associated with their use.

   WJ Tuning is not liable for damage, engine failure, reduced lifespan, or consequential damage resulting from modified, tuned, machined, ported, or performance-enhanced products including cylinders, crankcases, cylinder heads, or other engine components.

   The Customer acknowledges that tuning and performance modifications inherently increase mechanical stress and may affect reliability, durability, heat generation, tolerances, and engine lifespan.

   WJ Tuning is not liable for cracking, seizure, coating failure, material fatigue, detonation damage, overheating, or other failures occurring during or after use of tuned products.

   This specifically includes:

   • damage caused by increased engine load or RPM;

   • failure of modified engine components;

   • detachment or breakage of Nikasil coating particles or cylinder wall fragments;

   • piston or crankshaft damage;

   • bearing failure;

   • lubrication-related damage;

   • damage caused by racing or aggressive use.

   All tuning and machining work is performed entirely at the Customer’s own risk.

   WJ Tuning is not responsible for fines, WOK status, vehicle impoundment, inspection rejection, insurance consequences, or other legal or financial consequences resulting from the use of non-EU-approved, racing, tuning, or non-road-legal parts on public roads.

   Certain products are intended exclusively for racing, off-road, competition, or closed-circuit use and may not comply with local road regulations.

   The Customer remains solely responsible for verifying whether the use of a product is permitted under the laws applicable in their country or region.

   WJ Tuning is not liable for damage caused by:

   • incorrect installation;

   • improper tuning;

   • misuse;

   • racing use;

   • overheating;

   • lubrication failure;

   • incompatibility with other components;

   • incorrect assembly;

   • failure to follow instructions;

   • use outside intended applications.

   Any liability of WJ Tuning is limited to the purchase price of the relevant product unless mandatory law states otherwise.

   ---

   Article 11 – Digital Products and STL Files

   All STL files, CAD files, and digital products are intended for personal use only unless otherwise agreed in writing.

   The Customer may not redistribute, resell, share, or commercially exploit digital products without written permission from WJ Tuning.

   WJ Tuning is not responsible for:

   • failed prints;

   • printer calibration issues;

   • material incompatibility;

   • dimensional inaccuracies;

   • print quality;

   • durability;

   • printer settings;

   • tolerances;

   • damage caused by printed parts.

   The Customer remains responsible for selecting suitable materials and ensuring safe use.

   ---

   Article 12 – Returns and Transport

   Returned products must be securely packaged to prevent transport damage.

   Damage occurring during return transport due to insufficient packaging remains the responsibility of the Customer.

   WJ Tuning reserves the right to postpone refunds until products have been received and inspected.

   Unauthorized returns may be refused.

   ---

   Article 13 – Force Majeure

   WJ Tuning is not obligated to fulfill obligations if reasonably prevented from doing so due to force majeure including:

   • natural disasters;

   • strikes;

   • transport disruptions;

   • supplier failures;

   • internet outages;

   • power failures;

   • government measures.

   If force majeure continues for more than 30 days, both parties may terminate the agreement.

   ---

   Article 14 – Privacy and Data Protection

   WJ Tuning processes personal data in accordance with GDPR and applicable privacy legislation.

   Data is used solely for order processing, customer service, and legal obligations unless otherwise agreed.

   Personal data will not be sold to third parties.

   ---

   Article 15 – Applicable Law and Disputes

   These terms and conditions are governed exclusively by Dutch law.

   Disputes shall be submitted to the competent court in the Netherlands unless mandatory consumer law states otherwise.

   Consumers within the European Union may also use the European ODR platform where applicable.
