Article 1 – Definitions
- WJ Tuning: the sole proprietorship based in the Netherlands that offers products via www.wjtuning.nl.
- Customer: the natural or legal person who enters into an agreement with WJ Tuning.
- Agreement: any agreement between WJ Tuning and the Customer regarding the supply of products and/or services.
- Products: all parts and accessories offered through the webshop.
- Reflection period: the period within which the Customer can exercise their right of withdrawal.
- Payment provider: third parties such as Mollie that process payment transactions.
Article 2 – Applicability
- These general terms and conditions apply to all offers, orders, and agreements of WJ Tuning.
- Deviations from these terms and conditions are only possible if agreed upon in writing.
Article 3 – The Offer
- All offers on the webshop are non-binding and can be changed at any time.
- Apparent mistakes or errors in the offer do not bind WJ Tuning.
- The images and descriptions of products are as accurate as possible but may differ from reality.
Article 4 – The Agreement
- The agreement is established when the Customer places an order, and WJ Tuning confirms it.
- WJ Tuning reserves the right to refuse orders without stating a reason.
Article 5 – Right of Withdrawal
- The Customer has the right to return the order within 14 days without giving a reason, provided the product is unused and in its original packaging.
- The Customer must notify the return via email and return the product within 14 days after notification.
- Return shipping costs are at the Customer’s expense.
- WJ Tuning will refund the purchase amount within 14 days of receiving the returned product.
Article 6 – Prices and Payment
- All prices on the webshop include VAT and exclude shipping costs unless stated otherwise.
- Payment must be made via the offered payment methods, such as via Mollie.
- In case of payment via bank transfer, the full amount must be paid within 7 days of ordering.
Article 7 – Delivery and Shipping Costs
- WJ Tuning strives to dispatch orders within the specified delivery time. Any delays do not entitle the Customer to compensation.
- Shipping costs are clearly stated when placing the order.
- If a product turns out to be unavailable, the Customer will be informed and has the right to a refund.
Article 8 – Warranty and Complaints
- WJ Tuning guarantees that the delivered products meet reasonable expectations.
- If a product has a defect, the Customer must report this within 14 days of receipt.
- WJ Tuning will, at its discretion, proceed with replacement or refund.
- Complaints can be submitted via email. WJ Tuning aims to respond within 7 days.
Article 9 – Liability
- WJ Tuning is not liable for any damage resulting from the use of the delivered products.
- WJ Tuning’s liability is limited to the purchase price of the product.
- WJ Tuning is not responsible for indirect damage, including consequential damage, lost profits, or business damage.
Article 10 – Force Majeure
- WJ Tuning is not obliged to fulfill any obligations if prevented due to force majeure, such as natural disasters, strikes, or supplier failures.
- If the force majeure lasts longer than 30 days, both parties have the right to terminate the agreement.
Article 11 – Privacy and Data Protection
- WJ Tuning processes personal data in accordance with applicable privacy laws.
- Data is used solely for order processing and will not be shared with third parties without permission.
Article 12 – Refund and Return Policy
- Customers can return products within 14 days of receipt, provided they are unused and in their original packaging.
- Customers must notify WJ Tuning via email before returning any product.
- The costs for return shipping are the responsibility of the Customer.
- If the return meets the conditions, WJ Tuning will process the refund within 14 days of receiving the product.
- Refunds will be issued using the same payment method the Customer used for the purchase.
- Custom or special-order items are non-refundable unless they arrive damaged or defective.
- In case of damaged or defective items, the Customer must provide photographic evidence within 7 days of receipt.
Article 13 – Applicable Law
- These general terms and conditions are governed by Dutch law.
- Disputes will be submitted to the competent court in the Netherlands.
