Article 1 – Definitions

  1. WJ Tuning: the sole proprietorship based in the Netherlands that offers products via www.wjtuning.nl.
  2. Customer: the natural or legal person who enters into an agreement with WJ Tuning.
  3. Agreement: any agreement between WJ Tuning and the Customer regarding the supply of products and/or services.
  4. Products: all parts and accessories offered through the webshop.
  5. Reflection period: the period within which the Customer can exercise their right of withdrawal.
  6. Payment provider: third parties such as Mollie that process payment transactions.

Article 2 – Applicability

  1. These general terms and conditions apply to all offers, orders, and agreements of WJ Tuning.
  2. Deviations from these terms and conditions are only possible if agreed upon in writing.

Article 3 – The Offer

  1. All offers on the webshop are non-binding and can be changed at any time.
  2. Apparent mistakes or errors in the offer do not bind WJ Tuning.
  3. The images and descriptions of products are as accurate as possible but may differ from reality.

Article 4 – The Agreement

  1. The agreement is established when the Customer places an order, and WJ Tuning confirms it.
  2. WJ Tuning reserves the right to refuse orders without stating a reason.

Article 5 – Right of Withdrawal

  1. The Customer has the right to return the order within 14 days without giving a reason, provided the product is unused and in its original packaging.
  2. The Customer must notify the return via email and return the product within 14 days after notification.
  3. Return shipping costs are at the Customer’s expense.
  4. WJ Tuning will refund the purchase amount within 14 days of receiving the returned product.

Article 6 – Prices and Payment

  1. All prices on the webshop include VAT and exclude shipping costs unless stated otherwise.
  2. Payment must be made via the offered payment methods, such as via Mollie.
  3. In case of payment via bank transfer, the full amount must be paid within 7 days of ordering.

Article 7 – Delivery and Shipping Costs

  1. WJ Tuning strives to dispatch orders within the specified delivery time. Any delays do not entitle the Customer to compensation.
  2. Shipping costs are clearly stated when placing the order.
  3. If a product turns out to be unavailable, the Customer will be informed and has the right to a refund.

Article 8 – Warranty and Complaints

  1. WJ Tuning guarantees that the delivered products meet reasonable expectations.
  2. If a product has a defect, the Customer must report this within 14 days of receipt.
  3. WJ Tuning will, at its discretion, proceed with replacement or refund.
  4. Complaints can be submitted via email. WJ Tuning aims to respond within 7 days.

Article 9 – Liability

  1. WJ Tuning is not liable for any damage resulting from the use of the delivered products.
  2. WJ Tuning’s liability is limited to the purchase price of the product.
  3. WJ Tuning is not responsible for indirect damage, including consequential damage, lost profits, or business damage.

Article 10 – Force Majeure

  1. WJ Tuning is not obliged to fulfill any obligations if prevented due to force majeure, such as natural disasters, strikes, or supplier failures.
  2. If the force majeure lasts longer than 30 days, both parties have the right to terminate the agreement.

Article 11 – Privacy and Data Protection

  1. WJ Tuning processes personal data in accordance with applicable privacy laws.
  2. Data is used solely for order processing and will not be shared with third parties without permission.

Article 12 – Refund and Return Policy

  1. Customers can return products within 14 days of receipt, provided they are unused and in their original packaging.
  2. Customers must notify WJ Tuning via email before returning any product.
  3. The costs for return shipping are the responsibility of the Customer.
  4. If the return meets the conditions, WJ Tuning will process the refund within 14 days of receiving the product.
  5. Refunds will be issued using the same payment method the Customer used for the purchase.
  6. Custom or special-order items are non-refundable unless they arrive damaged or defective.
  7. In case of damaged or defective items, the Customer must provide photographic evidence within 7 days of receipt.

Article 13 – Applicable Law

  1. These general terms and conditions are governed by Dutch law.
  2. Disputes will be submitted to the competent court in the Netherlands.
