WJ Tuning – Terms and Conditions (Dutch)
Article 1 – Definitions
WJ Tuning: a sole proprietorship based in the Netherlands and operating through www.wjtuning.nl.
Customer: the natural person or legal entity that enters into an agreement with WJ Tuning.
Agreement: any agreement between WJ Tuning and the Customer regarding the delivery of products and/or services.
Products: all products, parts, accessories, tuning parts, digital files, and services offered through the online store.
Digital Products: downloadable files such as STL files, CAD files, manuals, and other digital content.
Cooling-off period: the period during which the Customer may exercise the right of withdrawal.
Payment provider: third-party companies such as Mollie that process payments.
Article 2 – Applicability
These terms and conditions apply to all offers, orders, agreements, and deliveries by WJ Tuning.
By placing an order, the Customer agrees to these terms and conditions.
Any deviations from these terms and conditions are valid only if agreed upon in writing.
Article 3 – Offer
All offers in the online store are non-binding and are subject to change at any time.
WJ Tuning is not bound by obvious errors, typos, pricing errors, or incorrect product information.
Product images, colors, specifications, and descriptions are presented as accurately as possible but may differ from the actual product.
The performance figures, tuning results, or compatibility listed are for reference only and depend on configuration, installation, adjustment, and usage.
Article 4 – Formation of the Agreement
The agreement is concluded as soon as the Customer places an order and WJ Tuning confirms it.
WJ Tuning reserves the right to refuse or cancel orders without providing a reason.
If a product turns out to be unavailable, the Customer will be notified as soon as possible and offered a replacement, store credit, or refund.
Article 5 – Prices and Payment
All prices listed include VAT unless otherwise indicated.
Shipping costs are not included unless otherwise stated.
Payment must be made using the payment methods provided.
If paying by bank transfer, the full amount must be paid within 7 days.
WJ Tuning reserves the right to suspend or cancel orders in the event of suspected fraud, abuse, or failed payments.
Article 6 – Delivery and Shipping
WJ Tuning strives to ship orders within the specified delivery time. Delivery times are approximate and not binding.
Delays do not entitle you to compensation or termination of the contract unless required by law.
Shipping costs are clearly displayed during checkout.
If an order was eligible for free shipping based on a minimum order value and a return causes the remaining order value to fall below this threshold, WJ Tuning reserves the right to charge the standard shipping costs or to deduct them from the refund amount.
The risk of loss or damage passes to the Customer upon delivery, unless otherwise required by law.
Article 7 – Right of Withdrawal
Consumers have the right to cancel the contract within 14 days of receiving the product without giving a reason.
WJ Tuning will not accept return requests more than 14 days after delivery, unless otherwise required by law.
The Customer must notify WJ Tuning of the cancellation via email within the cooling-off period and return the product within 14 days of notification.
Return shipping costs are the responsibility of the Customer unless otherwise agreed.
The Customer may only inspect the product to the extent that would be reasonably possible in a physical store.
Products must be returned in their entirety and, if reasonably possible, in their original packaging.
If returned products show damage, installation marks, wear and tear, missing parts, or signs of use that go beyond normal inspection, WJ Tuning reserves the right to apply a deduction for depreciation.
Products that have been assembled, modified, altered, painted, or used may not be eligible for a full refund.
If WJ Tuning has delivered one or more replacement products as a service or to resolve a complaint, and the Customer subsequently decides not to proceed with the purchase, WJ Tuning reserves the right to deduct reasonable costs for additional shipping, packaging, processing, and inspection from the refund amount, to the extent permitted by law.
Refunds will be processed within 14 days of receiving and inspecting the returned product, using the same payment method used for the purchase.
Article 8 – Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to:
-
custom products;
-
personalized products;
-
special-order products;
-
sealed products that cannot be returned after opening for hygiene or safety reasons;
-
digital products as soon as the download or access has begun.
Digital products such as STL files, CAD files, and downloads are non-refundable once delivered or downloaded.
Article 9 – Warranty and Complaints
WJ Tuning guarantees that the products delivered will, upon delivery, reasonably conform to the terms of the agreement.
The warranty covers only manufacturing defects that were present at the time of delivery.
The Customer must report any complaints or defects within 14 days of discovery and, upon request, provide sufficient information, photographs, or evidence.
If a complaint is valid, WJ Tuning may, at its discretion:

repair the product;
-
replace the product;
-
offer a partial refund;
-
offer a full refund.
WJ Tuning reserves the right to refuse further replacements at no charge if there is no demonstrable manufacturing defect.
Normal wear and tear, racing use, misuse, improper installation, incorrect adjustment, overheating, insufficient lubrication, detonation, faulty installation, incorrect fuel mixtures, modifications by third parties, or damage resulting from improper use are not covered by the warranty.
Performance and tuning parts are intended for experienced users and may require professional installation, adjustment, or additional modifications.
WJ Tuning cannot guarantee specific power gains, compatibility, reliability, or suitability for every engine configuration or application.
Installation or use of a product constitutes acceptance of the product’s condition and compatibility, unless there is a demonstrable manufacturing defect.
Complaints without sufficient evidence may be dismissed.
Article 10 – Liability
WJ Tuning is not liable for indirect damages, including consequential damages, loss of profits, business interruption, or loss of income.
WJ Tuning is not liable for personal injury, accidents, physical damage, death, or any other damages resulting from the installation, use, misuse, modification, or operation of products supplied by WJ Tuning.
Performance and tuning products increase mechanical stress and require professional installation and maintenance. The Customer accepts all risks associated with their use.
WJ Tuning is not liable for damage, engine failure, reduced service life, or consequential damages resulting from modified, tuned, milled, ported, or performance-tuned products, including cylinders, crankcases, cylinder heads, or other engine components.
The Customer acknowledges that tuning and performance-enhancing modifications place additional mechanical stress on the vehicle and may affect reliability, durability, heat generation, tolerances, and service life.
WJ Tuning is not liable for cracks, jams, coating issues, material fatigue, detonation damage, overheating, or other defects that arise during or after the use of tuned products.
This includes, among other things:

damage caused by increased load or RPM;
-
defects in modified engine parts;
-
detachment or breakage of Nikasil particles or cylinder wall fragments;
-
piston or crankshaft damage;
-
bearing damage;
-
damage caused by insufficient lubrication;
-
damage caused by racing or track use.
All tuning and machining work is performed at the Customer’s own risk.
WJ Tuning is not responsible for fines, WOK status, vehicle impoundment, vehicle rejection, insurance issues, or any other legal or financial consequences resulting from the use of non-EU-approved, racing, tuning, or non-street-legal parts on public roads.
Certain products are intended exclusively for racing, track, or off-road use and may not comply with local laws and regulations.
The Customer remains responsible for verifying whether the use of a product is permitted under the laws of the relevant country or region.
WJ Tuning is not liable for damage resulting from:
-
incorrect installation;
-
incorrect adjustment;
-
improper use;
-
racing use;
-
overheating;
-
lubrication problems;
-
incompatibility with other components;
-
incorrect assembly;
-
failure to follow instructions;
-
use other than the intended application.
WJ Tuning’s liability is limited to a maximum of the purchase price of the product in question, unless otherwise required by mandatory law.
Article 11 – Digital Products and STL Files
All STL files, CAD files, and digital products are intended solely for personal use unless otherwise agreed in writing.
You may not distribute, resell, or commercially exploit digital products without the written permission of WJ Tuning.
WJ Tuning is not responsible for:
-
failed prints;
-
printer calibration issues;
-
material incompatibility;
-
size differences;
-
print quality;
-
sustainability;
-
printer settings;
-
tolerances;
-
damage caused by printed parts.
The Customer remains responsible for selecting appropriate materials and ensuring their safe use.
Article 12 – Returns and Shipping
Returned products must be properly packaged to prevent damage during shipping.
Damage caused during return shipping due to inadequate packaging remains the responsibility of the Customer.
WJ Tuning reserves the right to delay refunds until products have been received and inspected.
Unauthorized returns may be refused.
Article 13 – Force Majeure
WJ Tuning is not obligated to fulfill its obligations if this is reasonably impossible due to force majeure, including:

natural disasters;
-
strikes;
-
transportation issues;
-
supplier disruptions;
-
internet outages;
-
power outage;
-
government measures.
If the force majeure situation lasts longer than 30 days, both parties have the right to terminate the agreement.
Article 14 – Privacy and Data Protection
WJ Tuning processes personal data in accordance with the GDPR and applicable privacy laws.
Data will be used exclusively for order processing, customer service, and to comply with legal obligations, unless otherwise agreed.
Personal data is not sold to third parties.
Article 15 – Governing Law and Disputes
These terms and conditions are governed exclusively by Dutch law.
Disputes shall be submitted to the competent court in the Netherlands, unless otherwise required by mandatory consumer law.
Consumers within the European Union may also use the European ODR platform, if applicable.

Obvious mistakes, typographical errors, pricing errors, or incorrect product information are not binding on WJ Tuning.
Product images, colors, specifications, and descriptions are intended to be as accurate as possible but may differ from the actual product.
Performance figures, tuning results, or compatibility information are for reference only and may vary depending on the setup, installation, tuning, and usage.
Article 4 – The Agreement

WJ Tuning reserves the right to refuse or cancel orders without providing a reason.
If a product becomes unavailable after an order is placed, the customer will be notified and offered a replacement, store credit, or refund.

Shipping costs are not included unless otherwise specified.
Payment must be made using one of the available payment methods.
Orders paid by bank transfer must be paid in full within 7 days.
WJ Tuning reserves the right to suspend or cancel orders in cases of suspected fraud, abuse, or failed payment.

WJ Tuning aims to ship orders within the stated delivery times. Delivery times are estimates and not strict deadlines.
Delays do not entitle the Customer to compensation or cancellation unless required by law.
Shipping costs are clearly displayed during checkout.
If an order qualified for free shipping based on a minimum order value and a returned item causes the remaining order value to fall below that threshold, WJ Tuning reserves the right to deduct the standard shipping costs from the refund amount.
The risk of loss or damage passes to the Customer upon delivery, unless otherwise required by law.
Article 7 – Right of Withdrawal
Consumers have the right to cancel the purchase within 14 days of receiving the product without giving a reason.
WJ Tuning does not accept return requests submitted more than 14 days after delivery, unless required by law.
The Customer must notify WJ Tuning of the cancellation via email within the cooling-off period and return the product within 14 days of notification.
Return shipping costs are the responsibility of the Customer unless otherwise agreed.
The Customer may inspect and evaluate the product only to the extent reasonably necessary to determine its nature, characteristics, and functionality, similar to what would be permitted in a physical store.
Products must be returned in their entirety and, where reasonably possible, in their original packaging.
If returned products show damage, installation marks, excessive wear, missing parts, or signs of use beyond normal inspection, WJ Tuning reserves the right to apply a proportional reduction to the refund amount.
Products that have been installed, modified, machined, painted, or used may not be eligible for a full refund.
If WJ Tuning has provided one or more replacement products as part of its service or to resolve a complaint and the Customer subsequently cancels the purchase, WJ Tuning reserves the right to deduct reasonable costs for additional shipping, handling, packaging, inspection, and processing from the refund amount where permitted by law.
Refunds will be processed within 14 days of receiving and inspecting the returned product, using the original payment method.
Article 8 – Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to:

custom-made products;
-
personalized products;
-
special-order items;
-
sealed goods that cannot be returned after opening for hygiene or safety reasons;
-
digital products once access or download has begun.
Digital products, including STL files, CAD files, and downloads, are non-refundable once delivered or downloaded.
Article 9 – Warranty and Complaints
WJ Tuning guarantees that the products delivered are in reasonable conformity with the agreement at the time of delivery.
The warranty covers only manufacturing defects present at the time of delivery.
The Customer must report complaints or defects within 14 days of discovery and provide sufficient evidence, photographs, or information upon request.
In the event of a valid complaint, WJ Tuning may, at its sole discretion:

repair the product;
-
replace the product;
-
provide a partial refund;
-
provide a full refund.
WJ Tuning reserves the right to refuse further free replacements if no manufacturing defect can be identified.
Normal wear and tear, racing use, misuse, incorrect installation, improper tuning, overheating, insufficient lubrication, engine knocking, incorrect assembly, unsuitable fuel mixtures, third-party modifications, or damage caused by improper use are excluded from warranty coverage.
Performance and tuning parts are intended for experienced users and may require professional installation, tuning, or additional modifications.
WJ Tuning cannot guarantee specific power gains, compatibility, reliability, or suitability for every engine configuration or application.
Installation or use of a product constitutes acceptance of the product’s condition and compatibility, unless a manufacturing defect can be demonstrated.
Complaints without sufficient evidence may be rejected.

WJ Tuning is not liable for personal injury, accidents, physical harm, death, or damage resulting from the installation, use, misuse, modification, or operation of products supplied by WJ Tuning.
Performance and tuning products increase mechanical stress and require professional installation and maintenance. The Customer assumes all risks associated with their use.
WJ Tuning is not liable for damage, engine failure, reduced service life, or consequential damage resulting from modified, tuned, machined, ported, or performance-enhanced products, including cylinders, crankcases, cylinder heads, or other engine components.
The Customer acknowledges that tuning and performance modifications inherently increase mechanical stress and may affect reliability, durability, heat generation, tolerances, and engine lifespan.
WJ Tuning is not liable for cracking, seizure, coating failure, material fatigue, detonation damage, overheating, or other failures occurring during or after the use of tuned products.
This specifically includes:

damage caused by increased engine load or RPM;
-
failure of modified engine components;
-
detachment or breakage of Nikasil coating particles or cylinder wall fragments;
-
piston or crankshaft damage;
-
bearing failure;
-
lubrication-related damage;
-
damage caused by racing or aggressive use.
All tuning and machining work is performed entirely at the customer’s own risk.
WJ Tuning is not responsible for fines, WOK status, vehicle impoundment, failure to pass inspection, insurance issues, or other legal or financial consequences resulting from the use of non-EU-approved, racing, tuning, or non-road-legal parts on public roads.
Certain products are intended exclusively for racing, off-road, competition, or closed-circuit use and may not comply with local traffic regulations.
The Customer remains solely responsible for verifying whether the use of a product is permitted under the laws applicable in their country or region.
WJ Tuning is not liable for damage caused by:
-
incorrect installation;
-
incorrect tuning;
-
misuse;
-
for racing use;
-
overheating;
-
lubrication failure;
-
incompatibility with other components;
-
incorrect assembly;
-
failure to follow instructions;
-
use outside of its intended applications.
WJ Tuning's liability is limited to the purchase price of the relevant product, unless required by law.
Article 11 – Digital Products and STL Files
All STL files, CAD files, and digital products are intended for personal use only unless otherwise agreed in writing.
The Customer may not redistribute, resell, share, or commercially exploit digital products without written permission from WJ Tuning.
WJ Tuning is not responsible for:

failed prints;
-
printer calibration issues;
-
material incompatibility;
-
dimensional inaccuracies;
-
print quality;
-
durability;
-
printer settings;
-
tolerances;
-
damage caused by printed parts.
The Customer remains responsible for selecting appropriate materials and ensuring their safe use.
Article 12 – Returns and Shipping
Returned products must be securely packaged to prevent damage during shipping.
The Customer remains responsible for any damage that occurs during return shipping due to inadequate packaging.
WJ Tuning reserves the right to delay refunds until products have been received and inspected.
Unauthorized returns may be refused.
Article 13 – Force Majeure
WJ Tuning is not obligated to fulfill its obligations if it is reasonably prevented from doing so due to force majeure, including:
